Highlights again the critical need for a federal anti-SLAPP statute, backstopped by strong state anti-SLAPP laws in the many states still lacking such important protections for press (and thus for the public) freedom. The right has determined that “Freedom of the Press Belongs to Them What Own It” and so, as they keep consolidating control over more and more mass media channels and intimidating more and more outlets, they feel there is little risk to stripping protections from media so that it becomes economically suicidal to report on the wrongdoing of the famous and powerful people and institutions. Without strong anti-SLAPP laws, even a winning defense against a bogus libel suit is ruinous. Hugely important book. Does a great job situating “Sullivan v NYT” where Roe v Wade was in 1972 and then 50 years later. A warning to us all.
